Terms of Service

1. Who provides the service

The 42flows service is provided by one of two entities, depending on where you are based:

• Customers in India: your contract is with Goforce Pvt Ltd., India ("Goforce Pvt Ltd.").
• Customers outside India: your contract is with Goforce Inc., a Wyoming corporation, USA ("Goforce Inc.").

"We," "us," and "42flows" in these terms refer to whichever entity contracts with you based on the rule above. The country recorded against your account at signup determines the entity. If you change country during the subscription lifetime, your contract may transfer to the other entity at the next renewal.

2. What the service does

42flows is an autonomous AI service that researches your business, generates and publishes SEO-optimized content to your connected platforms (WordPress, Shopify, Nuxt Content, GitHub repositories), optimizes existing pages for search and AI answer engines, monitors performance via integrations with services such as Google Search Console and Meta (Instagram), and surfaces insights via a customer dashboard and weekly reports.

We may modify, expand, or retire individual features over time. Material changes that reduce the service materially below what your current subscription tier promises will be communicated by email with at least 30 days' notice.

3. Account and signup

You must be at least 18 years old and authorized to bind your business to enter into this agreement. You agree to provide accurate, current information at signup and to keep it updated. You are responsible for keeping your account credentials secure and for any activity under your account.

4. Subscription, billing, and cancellation

4.1 Billing

The launch B2B website plan is $199/month and is billed monthly in advance once payment activation is live for the customer account. Customers outside India are billed through Stripe at launch. Customers in India are routed by billing country to Razorpay once Razorpay setup is complete.

The billing country recorded at signup determines the payment-provider route. Website markets, website domain, IP address, and search-market selections do not determine the payment processor.

4.2 Cancellation

You can cancel before the next renewal. Until the self-service billing area is live, cancellation requests are handled through [email protected]. After cancellation, service access ends at the end of the paid period unless we agree otherwise in writing, and your data enters the deletion schedule described in our Privacy Policy.

4.3 Refunds (pro-rata)

If you cancel mid-cycle, we refund the unused portion of the current billing month on a pro-rata daily basis. Example: if you paid for a 30-day month and cancel after 12 days, you receive a refund equal to 18/30 of the monthly fee. Refunds are processed within 14 business days via the original payment method.

Refunds are not provided for: usage already consumed in cycles before the current one; charges from third-party platforms (your hosting, your CMS, the SEO tools you use independently); or amounts owing on invoices that have already been paid for past cycles.

4.4 Taxes

Indian customers: GST will be applied as required under Indian law when Razorpay billing is active. International customers: prices exclude applicable taxes unless Stripe calculates and displays them during checkout or invoicing.

5. Acceptable use

You agree not to:

• Use the service to generate or publish fake reviews, fake testimonials, fake engagement, or any other content that misrepresents your business or another business.
• Resell, sublicense, or white-label the service without a separate written agreement.
• Reverse-engineer, scrape, or attempt to extract our skills, model prompts, agent orchestration, or other proprietary infrastructure.
• Use the service in violation of applicable law (anti-spam, defamation, intellectual property, consumer protection, data protection).
• Use the service to compete with 42flows by building a substantially similar product based on insights gained from access.

We may suspend or terminate accounts that violate this section, with refund prorated to the date of suspension where the violation is not malicious, or without refund where it is.

6. Your obligations

To operate the service we need certain things from you:

• A live business URL we can crawl, OR a Google Business Profile / Instagram handle we can read.
• Connected platform access (WordPress, Shopify, GitHub repository, etc.) so we can publish on your behalf, OR a webhook destination we can deliver to.
• Truthful answers to the onboarding Bridgy questions about your business.
• Maintenance of any OAuth tokens you grant us (Google Search Console, Meta) so the daily sync can run.

7. Intellectual property

You own all content that 42flows generates and publishes to your platforms on your behalf, in perpetuity. Once content is generated and delivered, it is yours.

We retain ownership of the underlying agents, skills, orchestration logic, models, dashboards, and any software or infrastructure we use to provide the service. Your subscription grants you the right to use the service; it does not transfer ownership of the underlying software.

You grant us a limited, non-exclusive license to use anonymized, aggregated data derived from your usage to improve the service for all customers (e.g., learning which content patterns rank better). This license does not extend to publishing your business data, your content, your competitors, or your identifiers to any third party.

8. Third-party services

The service depends on third-party providers including but not limited to OpenRouter, Anthropic, Google (Search Console, Maps, Business Profile, Imagen), Meta (Instagram Graph API), DataForSEO, fal.ai, Razorpay, Stripe, AiSensy, Twilio, Hetzner, Cloudflare, and Resend. Their terms govern your interaction with them where you connect directly (e.g., the Google or Meta OAuth consent screens). We do not control their availability and are not liable for outages, errors, or policy changes on their side.

9. Service availability

We aim for 99% uptime on customer-facing surfaces (dashboard, reports). We do not commit to a contractual SLA for Shape A launch customers. Scheduled maintenance is announced in advance where possible.

10. Disclaimers

The service is provided "as is" and "as available." We do not guarantee any specific search ranking, traffic increase, citation rate, revenue lift, or other business outcome. SEO and AI search outcomes depend on many factors outside our control (search engine algorithms, competitor activity, market shifts, the customer's own website quality, third-party platform stability).

To the maximum extent permitted by applicable law, we disclaim all warranties whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of liability

To the maximum extent permitted by applicable law, our total aggregate liability arising out of or relating to these terms shall not exceed the amount you paid to us in the 12 months immediately preceding the event giving rise to the claim. Neither party shall be liable to the other for indirect, consequential, incidental, special, or punitive damages (including lost profits, lost data, business interruption) even if advised of the possibility of such damages.

12. Termination

Either party may terminate this agreement at any time. On termination, your access ends within 24 hours and your data follows the deletion schedule in our Privacy Policy. Sections that by their nature survive termination (intellectual property, limitation of liability, governing law, disclaimers) survive.

We may terminate or suspend your access immediately if we reasonably believe you have materially violated these terms (including section 5).

13. Governing law and disputes

13.1 Indian customers (contract with Goforce Pvt Ltd.)

These terms are governed by the laws of India. Disputes will be resolved in the courts of India, with venue in the city where Goforce Pvt Ltd. is registered. Customers retain rights under the Digital Personal Data Protection Act, 2023.

13.2 International customers (contract with Goforce Inc.)

These terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-laws principles. Disputes will be resolved in the state or federal courts of Wyoming. Customers in jurisdictions with non-waivable consumer protection rights (e.g., the EU, UK, California) retain those rights.

14. Changes to these terms

We may update these terms over time. Material changes will be communicated by email to active customers at least 30 days before they take effect. The "Last updated" date at the top of this page always reflects the most recent change. Continuing to use the service after a change takes effect means you accept the updated terms.
